TERMS OF SALE
1. OWNERSHIP DETAILS
1.1. The owner of the online store www.autoextra.ee (hereinafter referred to as the Online Store) is Autoextra OÜ (registration code 12090540), located at Värvi 5-A112, Tallinn 10621.
2. VALIDITY OF THE SALES CONTRACT, GOODS, AND PRICING INFORMATION
2.1. These terms of sale apply when purchasing goods from the Online Store. The prices of products sold in the Online Store are indicated next to the products. A delivery fee will be added to the price of the goods. The delivery fee depends on the Buyer’s location and the method of delivery. The delivery fee is displayed to the Buyer when placing the order. Information about the goods is presented directly next to the goods in the Online Store.
3. PLACING AN ORDER
3.1. To order goods, the desired products must be added to the shopping cart. To place an order, the required fields must be filled in, and an appropriate method of product delivery must be selected. Subsequently, the fee amount will be displayed on the screen, which can be paid via a bank link or another payment solution. The contract becomes effective once the amount due for payment is received in the Online Store’s bank account.
3.2. If the ordered goods cannot be delivered due to the goods being out of stock or for another reason, the Buyer will be notified as soon as possible, and the paid money (including delivery costs) will be refunded within 1-2 business days. Depending on the payment method, the receipt of funds may take up to 7 business days.
4. DELIVERY
4.1. Goods are shipped to the following countries: EU.
4.2. The Buyer bears the shipping costs, and the corresponding price information is displayed alongside the delivery method.
4.3. Domestic shipments within Estonia generally reach the Buyer’s designated destination within 3-7 business days from the effective date of the sales contract. Deliveries outside Estonia are made within 3-10 calendar days.
4.4. In exceptional cases, the Seller has the right to deliver the goods within up to 30 calendar days.
4.5. If the Online Store has informed the Buyer about delivery problems and an extended deadline exceeding 30 calendar days on the website or in the order confirmation, the deadline published by the Online Store applies.
5. RIGHT OF WITHDRAWAL
5.1. After receiving the order, the Buyer has the right to withdraw from the contract concluded in the Online Store within 14 days [depending on the products, the Buyer may not have the right to withdraw; in such cases, the corresponding products and services must be listed, and they must meet the conditions specified in Section 53 (4) of the Obligations Act].
5.2. The right of withdrawal does not apply if the Buyer is a legal entity.
5.3. To exercise the 14-day right of withdrawal, the ordered goods must not be used in any way other than necessary to verify the nature, characteristics, and functioning of the goods, as permitted when trying the goods in a physical store.
5.4. If the goods are used for purposes other than necessary to verify the nature, characteristics, and functioning of the goods, or if there are signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods.
5.5. To return the goods, the Buyer must submit a declaration of withdrawal from the purchase of goods and send it to the email address info@autoextra.ee no later than 14 days after receiving the goods.
5.6. The Buyer bears the costs of returning the goods, except if the reason for return is that the returned item does not correspond to the order (e.g., wrong or defective item).
5.7. The Buyer must return the goods within 14 days after submitting the declaration or provide proof that the goods have been handed over to the carrier within the aforementioned period.
5.8. Upon receiving the returned goods, the Online Store will refund all payments received from the Buyer under the contract without delay, but no later than 14 days from the receipt of the declaration of withdrawal.
5.9. The Online Store may refuse to make refunds until the returned item subject to the contract has been received or until the Buyer has provided evidence that the item has been sent back, whichever occurs first.
5.10. If the Buyer has chosen a delivery method different from the cheapest standard delivery method offered by the Online Store, the Online Store is not obliged to refund costs that exceed those associated with the standard delivery method.
5.11. The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the Buyer if the price of the goods in the Online Store is significantly below the market price of the goods due to an error.
6. RIGHT TO FILE A COMPLAINT
6.1. The Online Store is responsible to the Buyer for non-compliance or defects of the goods sold that existed at the time of handing over the goods and that become apparent within two years from the date of handing over the goods to the Buyer. It is assumed that any defect was already present at the time of handing over the goods within the first year from the date of handing over the goods. It is the Online Store’s obligation to disprove this assumption.
6.2. The Buyer has the right to contact the Online Store with a complaint no later than two months after the defect becomes apparent by sending an email to info@autoextra.ee.
6.3. The Online Store is not responsible for defects that have arisen after handing over the goods due to the Buyer’s actions or inactions (incorrect use, accidents, etc.) or if the defects are due to normal wear and tear from ordinary use.
6.4. If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales contract to the Buyer.
6.5. The Online Store will respond to the Buyer’s submitted complaint in writing or in a form that allows for a written reproduction within 15 days.
7. DISPUTE RESOLUTION
7.1. If the Buyer has complaints regarding the Online Store, they must be sent via email to info@autoextra.ee. If the Buyer and the Online Store are unable to resolve the dispute through agreement, the Buyer has the option to contact the Consumer Disputes Commission.
7.2. The procedural conditions can be reviewed, and applications can be submitted here. The Consumer Disputes Commission is competent to resolve disputes arising from the contract concluded between the Buyer and the Online Store. Reviewing the Buyer’s complaint by the commission is free of charge. The Buyer may also refer to the European Union's online dispute resolution platform here.
7.3. If the commission’s decision is not accepted, the parties have the right to approach the district court corresponding to the Buyer’s location.
